Terms of Service

1 Acceptance of Terms

By accessing our website, creating an account, or using any FiberCity service, you confirm that you are at least 18 years old, have the legal authority to enter into a binding agreement, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2 Description of Services

FiberCity provides residential and business fibre broadband internet services across New Zealand, including but not limited to:

• Fixed-line fibre broadband plans.
• Router and equipment supply and rental.
• Technical installation and support.
• Online account management via our customer portal.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

3 Account Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@fibercity.co.nz if you suspect unauthorised access.

4 Billing & Payment

• Services are billed monthly in advance unless otherwise stated in your plan.
• Payment is due on the invoice due date. Late payments may result in service suspension.
• All prices are in New Zealand Dollars (NZD) and are inclusive of GST (15%) where applicable.
• We reserve the right to adjust pricing with 30 days' written notice.
• Refunds are considered on a case-by-case basis and are not automatic for early cancellation.

5 Acceptable Use Policy

You must not use our services to:

• Engage in illegal activities or violate any New Zealand or international law.
• Distribute malware, spam, or conduct phishing attacks.
• Infringe copyright or other intellectual property rights.
• Interfere with or disrupt the network or services of FiberCity or third parties.
• Resell or redistribute FiberCity services without written authorisation.
• Access or attempt to access systems or data without authorisation.

Violations may result in immediate suspension or termination without refund.

6 Fair Use

Plans advertised as "unlimited" are subject to a fair use policy. We may manage traffic or contact you if your usage significantly impacts the experience of other customers. We will always try to resolve such situations with reasonable notice before taking any action.

7 Service Availability

We strive to provide a reliable, high-quality service. However, we do not guarantee uninterrupted or error-free access. Scheduled maintenance, emergency repairs, third-party network outages, or events beyond our reasonable control (force majeure) may cause temporary disruptions. We will endeavour to provide advance notice of planned maintenance where possible.

8 Equipment

Any equipment supplied or rented by FiberCity remains our property. You are responsible for keeping it safe and in good working condition. Lost, stolen, or damaged equipment may result in a replacement charge. Equipment must be returned upon termination of your service.

9 Termination

Either party may terminate the service agreement:

• You may cancel by giving 30 days' written notice to us. Early termination fees may apply if you are within a fixed-term contract.
• We may suspend or terminate your service immediately for breach of these Terms, non-payment, or fraudulent activity, or with 30 days' notice for any other reason.

10 Limitation of Liability

To the maximum extent permitted by the Consumer Guarantees Act 1993 and Fair Trading Act 1986, FiberCity's liability for any claim arising out of or in connection with these Terms or our services is limited to the amount you paid for the service in the month in which the issue arose. We are not liable for indirect, consequential, incidental, or special damages.

11 Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12 Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand. Nothing in these Terms limits rights you may have under the Consumer Guarantees Act 1993.

13 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on our website at least 14 days before they take effect. Continued use of our services after that date constitutes acceptance of the revised Terms.
